Benue: APC Member Drags Party To Court Over Nomination Form Fee Refund

A former member of the House of Representatives for Kwande/Ushongo Federal Constituency in Benue State, Barr. Benjamin Wayo, has dragged his party, All Progressives Congress (APC) and two others before a Federal High Court in Makurdi, praying for a refund of the N10 million with which he purchased the party nomination form.

The aspirant is also claiming the sum of N80 million as damages from the defendants, which includes the Independent National Electoral Commission (INEC) and the party’s Kwande/Ushongo Federal Constituency candidate, Terseer Ugbor, jointly and severally.

Wayo is seeking a declaration by the court that, having regard to the provision of section 29(1)and 84(1), (2),(4)a-c of the Electoral Act, 2022(as amended), Article 20 of the  APC Constitution 2022(as amended), and Article 18,19,21 and 22(II) 2 of APC Guidelines for the nomination of candidates for 2023 general elections, the purported nomination of Terseer Ugbor was done in palpable violation of the provisions of the Electoral Act, APC Constitution and is null and void. 

The plaintiff stated that he bought his nomination form to contest a proper and valid primary, but instead the party without conducting a primary election picked Ugbor as its candidate for the Kwande/Ushongo House of Reps seat. 

He said the party has no choice but to refund his money. Although, the second defendant, Mr Ugbor was yet to be served.

Nguevese Nyikwah, counsel to Wayo,  applied for service of court processes on Mr Ugbor through substituted means, which the court granted. 

The Presiding Judge, Justice Abdul Dogo adjourned the case to September 13 for hearing.
