Election Tribunal: Why Tinubu, APC Are Opposed To INEC Giving Materials To Atiku

President Bola Tinubu and the All Progressives Congress (APC) are opposed to the bid by Atiku Abubakar to engage ad-hoc INEC staff to provide evidence in his petition challenging the outcome of the 2023 presidential election.

The former president had subpoenaed three ad-hoc workers of INEC to give first-hand accounts of their experiences during the presidential poll.

Speaking via Wole Olanipekun (SAN), President Tinubu objected to the use of statements made on oath by witnesses for Atiku's petition.

According to the President and the APC, the statements of the ad-hoc workers were not front-loaded at the time of filing the petition.

Olanipekun cited several provisions of the law against the use of witnesses, arguing that since they were subpoenaed by Atiku as the petitioner, he ought to have front-loaded their statements on oath along with the petition.

He subsequently urged the court to reject the witnesses and discountenance their statements on grounds of violating the provisions of the Electoral Act 2022.

The Presiding Judge, Justice Haruna Simon Tsammani, announced that ruling in the objections had been reserved.

He also ordered that the evidence of the three subpoenaed witnesses be taken and the respondents cross-examine them.
