Community seeks court's intervention against land crises cau

Residents of Bakingazai Dankunkuru Communities in Ungogo Local Government have turned to Kano State Upper Shari’ah Court to stop one Ahmad Idris from digging a trench in the community in order to install a water pipe for borehole construction.

According to the complainants’ legal representatives, led by Barrister Sani Yakubu Ibrahim, Ahmad’s actions pose a threat to their families as the trenches support erosion.

He said the community has been grappling with erosion for the past seven years and urged the court to consider the plight of the masses.

The lawyer suggested that the defendant could relocate his dig to another area, avoiding harm to anyone.

Furthermore, the lawyer urged the court to send its representatives or have the presiding judge personally visit the site to assess the extent of the erosion and Ahmad’s actions, in order to facilitate a fair decision for both the complainants and the defendant.

In response, Idris Ahmad’s counsel, Barrister Tijjani Kabir Dukawa, stated that he, as a minister in the temple of justice, would not obstruct the court’s pursuit of fairness for both parties.

He added that his client’s hope is for the court to resolve the matter amicably, emphasizing that Ahmad is also a member of the community.

Barrister Dukawa argued that his client has already purchased the necessary equipment and started construction.

He noted that changing the project’s location would lead to additional costs.

However, he did not object to the request made by the complainant’s counsel for the court to visit the location and ensure justice for both parties.

The presiding judge, Garba Hamza Malafa, has scheduled a visit to the location for tomorrow, Thursday.
