2023 Presidency: Atiku Files Petition, Says Tinubu's Victory

As the legal drama revolving around the 2023 presidency continues to unfold, another main player has joined the fray as PDP's presidential flag bearer, Atiku Abubakar has filed a petition against Bola Tinubu's victory at the poll.

Atiku's latest move comes on the heels of Labour Party's Peter Obi's petition on Tuesday challenging the process through which Tinubu was declared the winner and his candidacy.

In the latest petition marked CA/PEPC/05/2023 and lodged before the Presidential Election Petition Court sitting at the Abuja Division of the Court of Appeal, Atiku seeks the withdrawal of the Certificate of Return given to Tinubu by the Independent National Electoral Commission (INEC).

The former vice president says that the commission declaring Tinubu as the winner of the 2023 presidential election is “invalid by reason of non-compliance with the provisions of the Electoral Act, 2022”.

Via his legal team led by Joe Kyari Gadzama (SAN), Atiku argues that Tinubu’s election is invalid by reason of corrupt practices.

“The 2nd Respondent was not duly elected by a majority of lawful votes cast at the Election.

“The 2nd Respondent was at the time of the Election not qualified to contest the Election”, the document added.

Atiku is praying the court to declare him the winner of the poll given that he got the second-highest number of lawful votes cast in the election.
