2023: Tinubu Records Victory As Court Strikes Out Suit Seeki

The suit seeking to disqualify the presidential candidate of the All Progressives Congress (APC), Bola Tinubu has been struck out by a Federal High Court in Abuja.

The former Lagos governor was taken to court by the Action Peoples Party (APP) in the suit marked FHC/UM/CS/124/2022, with the Independent National Electoral Commission (INEC) as the first defendant.

Tinubu is the second defendant while the APC is the third defendant.

In the suit, the plaintiff argued that Tinubu allegedly submitted to the 1st defendant false information in his form EC9 and did not include his primary and secondary education in his form CF001 of 1999 submitted ahead of the gubernatorial election.

Section 29 of the Electoral Act 2022 and 131 of the 1999 Nigerian Constitution had been cited by the APP.

A  notice of preliminary objection was filed by APC counsel, Babatunde Ogala, who insisted that the statute was barred and that the APP had no locus standi.

APC campaign spokesperson, Bayo Onanuga stated that the plaintiff was not present in court when the case came up before Justice Emeka Nwite.

“Justice Nwite subsequently struck out the case for lack of diligent prosecution”, he added.
