A Federal High Court in Abuja has struck out the fundamental rights suit filed by the suspended Deputy Commissioner of Police, Abba Kyari, against the National Drug Law Enforcement Agency (NDLEA).
Per a Punch report, Justice Inyang Ekwo dismissed the suit on Thursday after the counsel for the NDLEA Joseph Sunday prayed the court that the case be struck out.
Abba Kyari's lawyer, Cynthia Ikena, was absent when the matter was called and Sunday called on the court to strike out the suit.
Ekwo disclosed that he was told that a letter was sent by Ikena, praying the court for an adjournment. However, the letter was not filed by the lawyer and therefore not in compliance with the court rule.
The judge subsequently instructed that the said latter be shown to the NDLEA's counsel.
Expressing surprise with development, Sunday said he was not copied in the letter in line with the rule of the court and made the plea for the suit to be struck out.
