Bayelsa: Sylva's name added to governor candidate's list fol

The Independent National Electoral Commission (INEC) has included Timipre Sylva, the candidate of the All Progressives Congress (APC), in the final list of candidates for the November 11, 2023 gubernatorial election in Bayelsa State.

INEC stated in the updated list, which was published on its website, that the insertion of Sylva's name was per an Appeal Court decision made on October 31, 2023, which overturned Sylva's candidature for the election.

In the revised list obtained by Channels Television on Monday, Sylva was pencilled in as an APC gubernatorial candidate, with Maciver Joshua listed as his running partner.

"It may be recalled that the final list of candidates for the 2023 Bayelsa State Governorship Election was amended on 16th October 2023 under the Order of the Federal High Court in Suit No - FHC/ABJ/CS/821/2023 in respect of the nomination of the candidate of the All Progressives Congress (APC) for the 2023 Bayelsa State Governorship Election. 

"In Appeal No - CA/ABJ/CV/1060/2023, delivered on October 31, 2023, the Court of Appeal set aside the judgement of the lower court cited above.

"By Section 287 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended), the Commission is obligated to enforce Court Orders on nomination of candidates by political parties in the state. 

“The list of candidates in respect of the 2023 Bayelsa State Governorship Election is hereby amended in Amendment No. 2 pursuant to the judgement of the Court of Appeal", INEC said in a statement accompanying the amended list.

Sylva, a former Bayelsa governor and former Minister of State for Petroleum Resources, is competing against 15 other candidates, including the incumbent governor, Duoye Diri of the Peoples Democratic Party (PDP).

He was disqualified from running for governor of the state by a Federal High Court in Abuja on October 10.

Sylva, who has been sworn in twice and served as governor of the state for five years, would violate the 1999 constitution as amended if permitted to run again, according to Justice Okorowo.

The judge also ruled that Sylva was ineligible to run in the November election because, if elected, he would serve as governor of the state for more than eight years.

But the former minister challenged the lower court's ruling, and last Tuesday the appeals court found in his favour.

From May 2007 to April 2008 and again from May 2008 to January 2012, Sylva served as the governor of Bayelsa State.
