Court Changes Bail Conditions For Muhuyi Magaji Rimin Gado

A Kano State Magistrate has swapped earlier bail conditions for former Chairman of Kano Public Complains and Anti-Corruption Agency, Muhuyi Magaji Rimin Gado, who is standing trial on allegations giving false information contrary to section 140(a) of Penal Code with new ones.

The court made the variation upon a motion on notice by counsel to the defendant, Barrister Muhammmad Dan Azumi.

The Number 58 Magistrate Court presided over by Aminu Muhammmad Gabari had earlier said the former chairman would be bailed in the sum of N500,000 to the defendant with two reliable sureties in like sum.

The court ordered that the first surety be either a biological father, paternal or maternal uncle of the defendant, who will produce three years tax clearance or surrender his international passport.

The second surety according to the court, shall be the Imam of Jaen Friday Mosque or village head of Jaen in the alternative.

The court gave the earlier ruling on a Friday but Rimin Gado was said to have presented others, not the ones specifically ordered of him and secured his release.

However, on May 4, counsel to Barrister, Muhuyi Magaji Rimin Gado, Barrister Muhammmad Dan, Azumi filed a motion on notice dated May 4 and move on the May 9.

In an 11-paragraph affidavit duly deposed to by defendants himself, the counsel prayed the court to effect the variation, and informed the court that the biological father of the defendant is dead.

The counsel told the court that the defendant is a man of honour and a lawyer who has a good reputation in society.

“That the offence alleged to have been committed by Muhuyi according the (FIR) is bailable in nature and if found guilty the maximum punishment term is one year imprisonment or fine of 20 pound or both.”

On the other side, the state prosecuting counsel, Barrister Wada Ahmad Wada, in an 11-paragraph counter affidavit duly deposed to by one Zulkifli Ahmad prayed the court to declare the two sureties presented by the defendant unsuitable to stand for him.

The counsel argued that the defendant didn’t fulfill the bail conditions to secure his release from custody.

He stressed that no where court stated a brother to the defendant or limamin gari of Rimin Gado as part of the bail conditions ordered by the court.

Wada prayed the court to declare the two sureties unsuitable.

In his ruling, Gabari said the judge has the power to make or revoke an order.

Where there is no rule or expressively stated, the judge has power to use equity and natural justice.

He therefore varied the conditions the bail conditions earlier ordered against Rimin Gado.

“The court now order the defendant to produce his brother instead of his biological father, paternal or maternal uncle earlier ordered against him.

The court similarly varied the condition of imam of Jaen Friday mosque or village head of Jaen to any recognised member of society.

He ordered that other conditions remain unvaried.

The case had been adjourned to May 30th, for hearing.
