The Court of Appeal in Makurdi on Tuesday dismissed the appeal filed by Governor Samuel Ortom against the judgement of the Benue State High Court which had nullified the ban on use of motorcycles in Sankera.
Ortim on December 29, 2020, had banned motorcycles in Sankera, a community in the state, on grounds of insecurity without resorting to the Benue State House of Assembly to enact a law to authorize his actions.
Following the ban, the community approached the Court contending that the ban was unconstitutional and illegal.
The Court agreed and nullified the ban, however, the Governor appealed to the Court of Appeal, Makurdi.
Delivering the verdict, the Justices in the court of appeal unanimously agreed that without any law enacted by the Benue State House of Assembly, the Governor had no right of the law in banning the use of motorcycles anywhere in Benue State, including any part of Sankera, no matter the reason.
