A Federal High Court in Lagos has chosen March 1st as the date it will be ruling in a suit filed by the Peoples Democratic Party (PDP) candidate, Babatunde Gbadamosi, against the candidacy of Tokunbo Abiru of the All Progressives Congress (APC) at the Lagos East senatorial district by-Election.
Gbadamosi had asked the court to disqualify Abiru the winner of the by-election for allegedly violating section 31 of the Electoral Act, amongst others.

Abiru was declared the winner of the December 5, 2020 election by the Independent National Electoral Commission (INEC).
On hearing both parties argument on the issue, the judge adjourned till March 1.
The respondents argued that the plaintiffs’ case lacks merit as the candidate was duly nominated and qualified for the by-election.
The APC was represented in the case by Abiodun Owonikoko (SAN) while Kemi Pinheiro (SAN) stood in for Abiru.
Recall that Abiru defeated Gbadamosi to emerge as the winner of the Lagos East senatorial district by-election, following the demise of senator Adebayo Osinowo who died of COVID-19 in June 2020.
Gbadamosi is looking to break the stronghold of APC in the state by overturning the outcome of the by-election at State's the high court.
