Court Fixes New Date In Case Against Sacked Anti-Corruption

A Federal High Court in Kano has fixed March 28, 2022, to hear the application by counsel to Barrister Muhuyi Magaji Rimin Gado who is praying the court to further restrain the Police from arresting or prosecuting him in the allegation of forgery against him.

Justice Jane Iyang fixed the new date on Thursday after the court dismissed Rimini Gado’s application to restrain the Inspector General of Police from arresting him for lack of jurisdiction on March 1, 2022.

Earlier in her Judgment, Justice Jane upheld that the Applicant’s fundamental rights alleged violation was a mere ancillary claim which does fall within the purview of fundamental rights.

She further upheld that, for a court to determine fundamental rights violation, the claim of the applicant must be on infringement of his fundamental rights.

She also said her court lacks supervisory power over Kano State House of Assembly, stressing that Rimini Gado ought to have reached out to the Kano State High Court, not the Federal High Court, and dismissed the case.

When the Court reconvened on Thursday, Counsel to Muhuyi Magaji Barrister R.O Zakariyya filed an application seeking the court to order parties in the suit to maintain status quo, following the Judgement of the court delivered on March 1, 2022 pending the hearing and determination of an appeal against the judgement.

Counsel to the defendants, and Principal State Counsel, Barrister Wada Ahmad Wada, told the court that he has filed and served the Applicant’s counsel with the claim and counterclaims.

Consequently, Justice Iyang adjourned its sitting to March 28, 2022 for a hearing.
