Court Stops Swearing-In Of Abuluya As President Of Community

A High Court in Nasarawa State has granted an order stopping the swearing-in of Chief David Mandy Abuluya as President of the Eggon Community Development Association (ECDA). 

Justice Simon Aboki of the state High Court sitting in Lafia granted the order in a suit filed by Enoch Ali Maku, a presidential aspirant in the just conducted election of the association. 

The election which held on Saturday, November 27th returned as elected, Abuluya, as President alongside others. 

Friday, December 11 had been scheduled for the inauguration of the new officials. This, however, has been stopped as Maku has approached the court and obtained a restraining order. 

"An Order of Court restraining the 1st Defendant/Respondent or anybody acting under him from presenting himself for swearing-in as the elected President of Eggon Cultural and Development Association (ECDA) on 11th December 2021 or any date at all pending the determination of the motion for interlocutory injunction filed before the Court.

"An Order restrained the 2nd to 6th Defendants/Respondents from presenting or swearing in the 1st Defendant as the elected President of ECDA on the 11th December 2021 or any date at all pending the determination of the motion for interlocutory injunction filed before the Court.

"An Order restraining the 7th Defendant/Respondent from handing over to the 1st Defendant/Respondent s the elected President of ECDA at any time pending the determination of the motion for interlocutory injunction filed before the Court", Court ordered. 

The Suit No. NSD/MG 116/MI/2021 has Enoch Ali Maku as Plaintiff/Applicant while David M. Abuluya (President-Elect, ECDA), Danladi Suleiman Gyabo (Chairman, ELCOM ECDA), Barr Ayuba Ezekiel Enjugu (Secretary, ELCOM ECDA), Akolo A. Anzaku (Member, 2021 ELCOM), Allan Tsaku (Member, 2021 ELCOM), Andrew Amos (Member, 2021 ELCOM) and Wilberforce Alaku (Outgoing President, ECA) are the 1st, 2nd, 3rd, 4th, 5th, 6th and 7th Defendants/Respondents respectively. 

Meanwhile, the Court has adjourned to Monday 13, December for a hearing on the interlocutory motion.
