A High Court sitting in Ado Ekiti, the capital of Ekiti State, has overturned the appointment of the People's Democratic Party (PDP) Caretaker Committee in the state and reinstated the party's validly elected State Working Committee, led by Engr Alaba Agboola.
The party's State Working Committee, chaired by Agboola, is seen as loyal to former Governor Ayo Fayose.
In June of this year, the PDP's National Working Committee disbanded the party's executives in Ekiti state and established a Caretaker Committee led by Arch. Sadiq Obanoye.
Dissatisfied with the dissolution, Engr Alaba Agboola filed an action against the PDP Acting National Chairman, Umar Damagun, and two others under case number HAD/90/2023.
Justice O.I.O Ogunyemi ruled invalid and illegal the party's dissolution of the Ekiti State Executive Committee and fired the Caretaker Committee established by the National Working Committee on June 8, 2023, in his ruling issued yesterday.
The court also issued a permanent injunction "restraining Damagun and the PDP, their agents or any person or body of persons acting under the directives or instruction of the 1st and 2nd Defendants from recognising or further recognising the 3rd Defendant (Arch. Sadiq Obanoye) and the other members of the Ekiti State PDP Caretaker Committee as persons entitled to the affairs of the Ekiti State Chapter of the Peoples Democratic Party."
The court also issued a permanent injunction "retraining Arch. Sadiq Obanoye (3rd Defendant) and other members of the Ekiti State PDP Caretaker Committee from parading themselves as Ekiti State Caretaker Committee of the Peoples Democratic Party as well as running the affairs of the Ekiti State Chapter of the Peoples Democratic Party."
