The suit instituted by the federal government seeking suspended DCP Abba Kyari's extradition to the US has been dismissed by Justice Inyang Eden Ekwo of the Federal High Court in Abuja.
Delivering the judgment on Monday, Ekwo held that the extradition request filed by the Attorney General of the Federation, AGF, on behalf of the Federal Government lacked merit and is liable to dismissal.
The extradition charges were filed by the federal government through the Attorney General to make way for Kyari's extradition to the United States to answer for fraud allegations.
According to Judge Ekwo, the federal government has no basis to file the extradition request having put Abba Kyari on trial in Nigeria in relation to the allegations against him in America.
Kyari had been fingered in the fraud case involving suspected internet fraudster Abass Ramon, better known as Hushpuppi, in a $1.1 million wire fraud, leading to the US government requesting the former's extradition to share his side of the story.
