We Will Sue FG For CONUA, NAMDA Registration — ASUU

The Academic Staff Union of Universities (ASUU) has revealed plans to sue the federal government over the registration of two factional unions.

Speaking on Channels Television on Thursday, ASUU's Counsel, Femi Falana, said “ASUU is going to court. It is going to be the NIC”.                    

The lawyer's statement w confirmed by the union's President, Prof Emmanuel Osodeke, in a chat with a correspondent.

“He (Falana) is our lawyer. So, that is correct,” Osodeke confirmed on Thursday morning.

The Federal Government presented registration certificates to two factional unions: the Congress of Nigerian Universities Academics (CONUA) and the National Association of Medical and Dental Academics (NAMDA).

According to the Minister of Labour and Employment, Chris Ngige, the unions will exist alongside ASUU and enjoy similar benefits as other tertiary education unions across the nation.

ASUU's counsel, however, described the registration of the unions as illegal, stressing that according to the Trade Unions Act, only one union is authorised to function in every sector.

“You can’t have two trade unions in the same sector. Only a union is allowed to be registered for all academics in Nigeria.

“That is the essence of the classification of trade unions because we used to have mushrooms in the First Republic so the government restructured the unions and grouped all academics together and all non-academics together. You can’t have two or three in one field,” he said.

The Senior Advocate of Nigeria, the Supreme Court judgment on the proliferation of trade unions (Erasmus Osawe V Registrar of Trade Unions) ruled "that your freedom of association is not totalled; it is also regulated by the Trade Unions Act so that there will be no proliferation of trade unions”.

ASUU commenced industrial action on February 14 over the government's failure to meet its demands including improved welfare, change of payment platform, and unpaid allowances among others.
