George Floyd died on May 25, 2020, after Derek Chauvin kept his knee on the back of his neck despite pleas from the former that he wasn't able to breathe.
According to a report by Global News, prosecutors are asking the Court of Appeals to put Chauvin's trial on hold until adding the third-degree murder count is resolved.

While speaking on the issue on Monday, March 8, 2021, Judge Peter Cahill stated that it was his intention to continue with the trial until he is told to stop.

His words, "Unless the Court of Appeals tells me otherwise, we're going to keep moving."
The selection of the jury is expected to start today, Tuesday, and Chauvin faces charges of second-degree murder and manslaughter.

Judge Cahill had been ordered by the Court of Appeals last week to consider reinstating a third-degree murder charge that he had dismissed. According to legal experts, reinstating the charge would improve the chances of getting a conviction.
Prosecutors and defense attorneys had on Monday agreed to dismiss 16 of the first 50 jurors they reviewed for "cause" after they responded to a questionnaire.
Following Floyd's death, Chauvin and three other officers were fired. The others will stand trial in August for aiding and abetting.
